Greetings All,
Had previously posted this story.....obviously in the wrong spot.....only 87 views. Stumbled apon it by accident while researching the comlications of filing a US tax return for those living abroad.
As monotonous as this film is,I strongly suggest you watch the intire film which takes you step by step in uderstanding what the truth of these laws are.

The Internal Revenue Service has lost a lawyer's challenge in front of a jury to prove a constitutional foundation for the nation's income tax, and the victorious attorney now is setting his sights higher.
"I think now people are beginning to realize that this has got to be the largest fraud, backed up by intimidation and extortion and by the sheer force of taking peoples property and hard-earned money without any lawful authorization whatsoever," lawyer Tom Cryer told WND just days after a jury in Louisiana acquitted him of two criminal tax counts.
And before you consign him to the legions of "tin foil hat brigades" who argue against paying taxes, and then want payment to explain how to do that, he addresses the issue up front.


"These snake oil peddlers have conned millions of dollars out of many well-intended patriots and left a trail of broken lives in their wake. … These charlatans should be avoided, not only because they will lead you to bankruptcy and prison, but because by association they discredit those who are telling the truth," he said.
The truth, he said, is where he comes in, with the launch of a new Truth Attack website that is intended to build on his victory, and create a coalition of resources to defeat – ultimately – the income tax in the United States.

Although the legal citations in the case tend to run the length of paragraphs, Cryer told WND the underlying issue is not that complicated. Essentially, he argued that income is not necessarily any money that comes to a person, but rather categories such as profit and interest.
He said the free exchange of labor for compensation has been upheld as a right by the Supreme Court, but that doesn't necessarily make the compensation income.
If ever such an argument were to be presented widely, Cryer said, the income to the federal government would plummet. But not to worry, he said, the expenses could be reduced equally by eliminating programs, departments and agencies that also have no foundation in the Constitution.
"The Founding Fathers intentionally restricted the taxing powers of the new federal government as a measure of restraint on its size. By exceeding that limited taxing authority the federal government has been able to obtain resources beyond its intended reach, and that money has enabled the federal government to exceed its authority," he said.
For example, he said, the Constitution does not empower the federal government to regulate education, or employment, and agriculture, yet it does so.
The jury in U.S. District Court in Louisiana voted 12-0 to find Cryer, of Shreveport, not guilty of failure to file income taxes for two years. He had been indicted in 2006 on charges of failing to pay $73,000 to the IRS in 2000 and 2001. The next step in his personal case will be up to the IRS and prosecutors, if they choose to continue the issue, he said.
But for the rest of the nation, he's working with Save-a-Patriot, the Free Enterprise Society, Live Free Now and his own Lie Free Zone to spread the message of the truth.
"There are three points that are important," he told WND. "There's no law making the average working man liable [for income taxes], there's no law or regulation that allows the IRS to contend that earnings are 100 percent profit received in exchange for nothing, and the right to earn a living through any lawful occupation is a constitutionally protected fundamental right, and it is exempt from taxation."
Spokesman Robert Marvin in Washington's IRS office told WND the Internal Revenue Code provides for taxation on salaries or wages, but when pressed for a specific citation, or constitutional provision, he said, "I can't comment."
Cryer's encounter with tax law began more than a decade ago when a friend told him the income tax was sham. Cryer started researching, hoping to keep his friend out of trouble. But his conclusions, after years of research, were exactly what his friend told him.
He researched not only tax laws, but also the documents pertaining to the drafting of the U.S. Constitution as well as the first income tax.
He said throughout his battle, he's offered at every turn to pay taxes if the IRS could show him the authorization, and that never has happened.
"The Criminal Investigation Division and Department of Justice both responded only with 'your position is frivolous.' I had never stated a position, so how could they know whether it was frivolous?" he said. "Imagine my sending you a bill for $1,000 and when you call me and ask what the bill was for I simply said, 'that position is frivolous, just write the check and send it in.'"
His acquittal, he said, was a precedent because it means "people can see and recognize the truth."
He said multiple Supreme Court opinions have affirmed an individual's ownership of his or her own labor, and "exercising your fundamental rights" is not taxable. "It is definitely a trade. What most people receive in the form of wages, salaries or in my case fees that they personally earned for their labor is not received in exchange for nothing."
He said there might be a profit that should be taxable, but there might not.
"The IRS lets Wal-Mart sell a trillion dollars worth of goods, but they can back out their cost of goods [before being taxed,]" he said. "The IRS considers, in the case of a Wal-Mart wage earner, 100 percent of what he takes in is profit."
"But he's using his life, energy and work lifespan, and depleting it as he goes," Cryer told WND. "[Working] is a God-given fundamental right that is protected under the Constitution and can't be taxed any more than exercising freedom of speech."
While he waits to see what, if anything, the IRS and Justice Department will do next in his case, he's working to coordinate the groups that are battling taxation as unconstitutional.
"I have started a campaign to unify [the work] and we've got a number of organizations that are sponsoring and supporting this campaign," he said. The goal is to get everyone "who is aware of the truth" organized so they can spread the word.
He warned without a restoration of constitutional basics, the nation is lost.
"Read your Constitution and you will see that the federal role does not include ANY authority to regulate or tax any citizen directly and that WE expressly reserved the right to rule and govern ourselves as States, not as mere political subdivisions," his website says.
"The Constitution does not allow the government to run your lives, but the money it is stealing from millions of Americans is the fuel for its over-reaching and kibitzing. Take the money back and we and our states and communities can again be free," he said.
The fight is over "our FREEDOM from rule by a DISTANT RULER, just as we fought to free ourselves of a distant England over 200 years ago," he said.

Without a doubt....the real question here are we oblicated to pay.

By no means am I suggesting not to.... This lawyer had the IRS destroy him prior to his day in court...ie; practice, etc....none the less, he did prove he was not oblicated to pay taxes...or atleast what the IRS deems taxable....

Try this guy out. He supposedly shows you how to file your income tax and get backk 100% of what youve paid in taxes because the average Joe Worker is not an employee under the tax laws. I never read the whole thing but what I have was interesting.

Agree....all citizens would have to unite to tackle such an unjust....and from what I am witnessing from afar, in regards to this election, will not be any time soon.

This is the very reason that we need to start some sort of New Revolution.

The Constitution has been trampled on by so many administrations, that the people of this country have sucked up as some sort of "rule of law".

This guy set a precident, and paid a price for it. It did not cost him his life, but it did cost him his livelihood.

Our founding fathers put their LIVES on the line to BUILD this country.

Are we all so lazy and waitng for a hand out too, that we won't stand up in mass and be counted for?

At the stepped up pace towards socialism that we are seeing, those hand outs will given at the cost of your freedoms.

Your income, your home ownership, your 401k's, your vacations, your vehicles, and your food will be dictated. They will no longer be freedoms, but government doled-out "gifts" that you will be begging for.

The reason Income Tax is a sham is because you actually do not recieve income.
When you work for someone, what you are doing is simply making an even trade. You are TRADING your labor for a fair and equal sum of exchange.

Thus a moot point.

However, if you make an investment and recieve a profit, then this could be considered income and taxed while allowing for future losses to offset said gains.

He shows that the income tax laws DO NOT say who(or anybody?)is liable for an income tax, how much, and there is NO penalties for not paying!!!
Everybody should be studying this topic whether or not you care to take on the government and the IRS. It will help you to get your head out of the sand. Once you start investigating the tax laws, you will find an OVERWHELMING amount of information showing the government abuse that has been going on for decades.

Everybody should be studying this topic whether or not you care to take on the government and the IRS. It will help you to get your head out of the sand. Once you start investigating the tax laws, you will find an OVERWHELMING amount of information showing the government abuse that has been going on for decades.

Have looked at it.....digging as deep as I can.....finding only small %,266 out of 2300, being charged.....and so far this was do to lieing on their return...atleast in Canada...by watching the last video I posted will reveal much more about the laws than I can here. As far as checking the specific laws for myself, getting alot of we cannot comment due to privacy laws. Will keep digging and inform all in my finds. Might be wasting my time...but I feel this does warrant more investigation.

Greetings All,

The best news I have found on said topic so far is there is a $50,000 award for anyone who can identify the section of the Internal Revenue Code which makes a typical worker liable for the income tax. Sounds like easy money....particularly if you work for the IRS and inflict the laws. According to the testimonies I have read.......there is'nt one.
Forgive me for not saving/posting all the links....just check out YouTube...exIRS....you will find some there.

Have found numerous charged and or had their case dismissed.....not a problem finding those.........however, when ever I thought I might be geting close to a case that might enlighted the matter a little more......only found "no publication" in the court files.
I have found a case in which is still in the courts. They have recieved an appeal because the judge revoked their 1st amendment...I think this was the case..to much reading.....here is a very small piece of their petition...

I have also read long ago that we dont have to pay but the IRS make it where you pay and BOY WILL YOU PAY. Many have tried not paying and I read of a lawyer that got away with out paying wish I had the url.

I also read a story of a lady in NY City she took off the cost of her time spent each month doing the book keeping from her quaterly statement and she won also.

Go figure - This was before I was even online over 15 yrs ago I heard this. DONT TRY IT NOW lol

Yes, the problem is that one or a few can't really challenge them, but if everyone did we might have a fighting chance (they might stop some but not all).

Just look at what happened to Irwin Schiff (father of stockbroker Peter Schiff) from the video on post #11 above. Irwin Schiff is currently in prison as he was not allowed to present his evidence...

One of the reasons I was willing to defend myself at my trial is that I believed I had the knowledge and legal proof to show that none of the government’s IRS witnesses were legally authorized to testify; and without their testimony the government had no case. (Government had no case anyway, on other grounds, but let’s forget about that.) However, the government’s three prosecutors (two from the Justice Department and one who pretended to be a judge), conspired to prevent me from introducing such proof. Therefore I suggest that all those facing a contrived criminal prosecution for allegedly violating some income tax law, proceed as follows.


First familiarize yourself with code §7608. It alone proves that the IRS has no authority to enforce the payment of income taxes. §7608 is broken down into subsections (a) and (b), and all the IRS personnel who enforce a federal tax must fall into one subsection or the other. Now, all Agents who fall under subsection (a) are only authorized to enforce Subtitle E Taxes, such as liquor, tobacco and firearms; while only those Agents who fall under subsection (b) might be authorized to enforce income taxes. However, the statute only identifies “Criminal Investigations of the Intelligence Division of the IRS” as falling within subsection (b). All other IRS Agents “by whatever term designated” are plainly excluded from subsection (b) and are specifically assigned to subsection (a), the subsection dealing with Subtitle E Taxes. Therefore, the only IRS Agents who can have any authority to enforce the income tax are criminal investigators of the Intelligence Division of the IRS. All other IRS personal “by whatever term designated” can only be involved in enforcing Subtitle E Taxes. I don’t see how this statute can be read any other way.

[FN1] Now Judge Dawson would not allow me to raise §7608 in order to impeach government IRS witnesses. For example, §7608(a)(1) specifically authorizes those falling within this subsection to “carry firearms.” However, no such authorization is given to those who fall into subsection (b). Therefore it is clear that it is against the law for any IRS Agent to carry a firearm in connection with the enforcement of income taxes. So when the government called former special agent Ted Wethje as a witness, I immediately asked him on cross examination, “Did you carry a firearm in connection with your IRS duties?” He would have had to answer yes, since all Special Agents carry guns.

This would mean he could only have been authorized to enforce liquor, tobacco and firearms taxes while all his enforcement activities involving income taxes, including testifying at my trial, were unauthorized and illegal. But Judge Dawson knew where I was going with this (since I covered it in my Motion to Suppress, [FN2] (since armed Special Agents concluded the raid on Freedom books). So he wouldn’t let Wethjie answer the question and stated that my question was “irrelevant,” and ordered me to “move on.”


For this reason I didn’t bother to raise the issue, when the government called another Special Agent as a witness, Sam Holland. Mr. Holland testified at length before the Grand Jury, and it was he who led the raid on Freedom books when his Gestapo Squad of 15 armed Special Agents carted off some 14,000 of my personal papers from Freedom Books. §7608(b)(1) proves that Holland’s testimony before the Grand Jury was unauthorized and illegal, as well as the seizure of those documents from Freedom Books.

(So what else is new?)


The question is what can we do to stop these illegal IRS witnesses from testifying? I think I have the solution. If you are being subjected to a criminal prosecution involving income taxes, prior to going to trial (and after filing my motions to dismiss as posted on my web site) file a motion in limine in which you move that only those IRS employees attached to the Intelligence Division of the IRS be allowed to testify. On what basis can the government oppose such a motion, since these are the only IRS personnel that §7608(b) authorizes to enforce the income tax?


In my view, all IRS personnel, other than those connected to the Intelligent Division of the IRS, must fall into subsection (a)—otherwise the statute is inconsistent. Certainly §7608 makes a distinction between those IRS Agents authorized to enforce Subtitle E taxes, and those supposedly authorized to enforce income taxes, a Subtitle A tax.

Therefore, how can any IRS employee who does not fall into subsection 7608(b) be authorized to testify at a trial designed to enforce the payment of income taxes?


But by raising this issue, pre trial, in the form of a motion in limine you have an opportunity to argue the issue; while at trial, the judge can arbitrarily, cut off all argument on the issue as happened to me. In my case, a motion in limine would certainly make it more difficult for the government to get special Agents and Revenue Officers to testify since, for a variety of reasons, they clearly fall into §7608(a) and thus can have no authority to enforce the income tax and this would be a very easy argument to make. And those are the IRS Agents, who at trial provide the most damaging (though totally fraudulent) testimony.


So get those motion in limine filed and let’s see how the Justice Department and the courts try to weasel out of §7608!

FN #1 Of course no IRS Agent is authorized to enforce the income tax for the reason contained in my supplemental appeal as posted on my web site. In addition, the the “Parallel Table of Authorities” shows that the implementing regulations for §7608 is in 27 CFR. There is no reference to their being in 26 CFR. Obviously all those convicted of an income tax crime have been framed on a variety of grounds. Hopefully these motions in limine will make it more difficult for the government to do so in the future."

Note that the government's response to all these issues is "frivolous" however the government's response is criminal for the reasons given in my motion. Notice the government makes no attempt to address the fact that they can't produce any delegation of authority from the secretary of the treasury delegating to the IRS the authority to collect income taxes or it's publication in the federal register. This of course demonstrates that the motto of the justice department which is "not to gain a conviction, but to see justice done" is so much BS. In reality they represent a greater collection of criminals than the people they prosecute.

Here are the Exhibits from that go with my latest motion above, "Motion to Dismiss since this court cannot have jurisdiction since the indictment fails to charge an offense" filed July 5, 2005.

The following will provide extensive and irrefutable proof of how federal judges and the Dept. Of "Justice" lawyers knowingly violate the law in order to convict defendants (Illegally) charged with income tax crimes, And why only misstatements of law ever "comes from the bench" at such trials.

Since the income tax was repealed in 1954 when Congress adopted the 1954 Code, it is clear that for 50 years federal judges in conspiracy with U. S. Department of Injustice prosecutors have been illegally and criminally prosecuting people for crimes that do not exist in connection with a tax that nobody owes.

Therefore, the fact that Judge Dawson along with all of the Government’s prosecutors in this case have been engaged in the same criminal conduct should surprise no one – except in this case, their criminal conduct was so blatant and Judge Dawson’s charge to the jury was so outrageously false in so many areas, that changes in the way criminal trials are conducted in the U.S. of A. must inevitably follow from these disclosures."
