مشروع قانون النفط والغاز لم يقدم الى مجلس النواب لغاية الانBill oil and gas has been submitted to the House of Representatives so far

انعقدت ندوة موسعة بدعوة من القائمة الوطنية العراقية تحت عنوان (وحدة السياسة الاستراتيجية الوطنية في المجال البترولي)، حيث قدم الدكتور مهدي الحافظ موجزاً لورقة بحثية تحمل ذات العنوان مقترناً بملاحظات و افكار اساسية بشأن قانون النفط و الغاز.وقد ركزت ورقة الدكتور الحافظ على الاطار الاستراتيجي للقانون المنشود و وحدة السياسة الاستراتيجية و صناعة القرار و اقرار العقود مع الشركات الاجنبية، فضلاً عن فاعلية المجلس الاتحادي و مكتب المستشارين المستقلين و اشكال الاستثمار بموجب القانون، بالاضافة الى اعطاء اهمية خاصة لعلاقة النفط بالتنمية الوطنية، و بذلك فان الورقة تضمنت معالجات موضوعية لهذه القضايا.وفي مقدمة الورقة ذكر الدكتور مهدي الحافظ عضو مجلس النواب/ وزير التخطيط الاسبق بانه من مزايا الثروة النفطية في العراق وفرتها الهائلة المتمثلة بالاحتياطي الثابت البالغ 115 مليار برميل و الاحتياطي المحتمل المقدر بـ " 215 " مليار برميل، كما ان كلفة الاكتشاف و التطوير هي الاوطأ في العالم حيث ان كلفة الاكتشاف اقل من سنت للبرميل الواحد و كلفة التطوير بين دولار و دولارين للبرميل الواحد، كما تعرض الدكتور الحافظ الى ان مشروع القانون لم يعلن رسمياً حتى الان و لم يقدم الى مجلس النواب حتى هذه اللحظة، لذا فان المناقشة تدور حول النص المتوفر و الصادر عن وزارة النفط بصورة غير رسمية، و الحال كذلك بالنسبة لمشاريع القوانين الاخرى الواجب النظر فيها الى جانب هذا القانون و المتعلقة بتوزيع الموارد او العوائد النفطية و "شركة النفط الوطنية " و (وزارة النفط، بالاضافة الى نموذج العقود).واوضح الدكتور الحافظ بان هناك من يشكك بالحاجة لاصدار قانون للنفط و الغاز او يدعو الى تأجيله، بسبب الظروف السائدة في البلاد و الاختلاف لوجهات النظر حول قضايا الساعة، و ازاء هذا الادعاء يمكن التنويه برأي مختلف اخر بنعم لسبب مهم و واضح، اذ لابد من وضع اطار مؤسسي قانوني و اداري لادارة العمليات النفطية، و استثمار هذا الخزين الكبير من الاحتياطيات الكامنة وفق رؤية استراتيجية و هادفة لتحقيق اقصى المنافع للشعب العراقي، كما ان ثمة ضرورة عاجلة للتنسيق بين السلطات الاتحادية و الاقليمية و المحافظات على اسس واضحة و مقننة تفادياً لاية ارتباكات و تداخلات في الصلاحيات بين هذه الجهات المختلفة، ثم توجد حاجة ملحة لصياغة نظام و قواعد واضحة لاشكال الاستثمار الاجنبي في هذا القطاع من خلال معايير و شروط واضحة ايضاً للتعاقد مع الشركات الاجنبية من شأنها ان تصون المصالح الوطنية.و من هنا لايمكن تقبل او تفهم الدعوة الى تأجيل النظر بقانون النفط و الغاز، باسباب تتعلق بمشروعية العملية السياسية و الوجود الاجنبي، فمهما يكون الاختلاف في وجهات النظر بشأن هذين الامرين و حول قضايا التطور السياسي في العراق بوجه عام، فالمصلحة الوطنية تقتضي ان لا يرتهن المستقبل الاقتصادي للبلاد و عصبه الاساسي الخزين النفطي الهائل بالتسويات السياسية حول هذه المشكلة او تلك من مشاكل التطور السياسي الراهن و من غير اكتراث لعامل الزمن.فالزمن قوة موضوعية غاشمة، لايمكن الغائها او صد تفاعلاتها مع التطور التاريخي، و يجب ان يحسب له حساب، ذلك ان الفرص ليست متاحة و مضمونة دائماً للتنمية الاقتصادية و الاجتماعية و جني المنافع من هذه الثروة و استثمارها.Symposium held extensive invitation of the Iraqi national list under the title (alone policy in the field of national strategic petroleum), as presented by Dr. Mahdi Hafiz summary of the paper carrying the title coupled with the observations and ideas on the basic law of oil and gas. About 6:15am EST on CNN, they were reporting the Summit with Iraq. One of the reporters was talking about different things with the summit with foreign Minister Zabari. The one question she asked Zabari was, how congress was upset on how the Iraqi Parliament was going to take a summer recess, when there are major things that need to be resolved. Zabari said that there will be no summer recess, parliament will be there to work. I just watched this on CNN. I am trying to find a reference to from CNN, as soon as I do I will post it.

I wasnt sure if this article was posted yet, it gives a different perspective on the whole subject. Who cares if it is posted 25 times or 100 times, at least their talking about it. Any info is always helpfull, that the reasoning for the post to gather everybodys thoughts and outlooks on the subjest at hand.

I know, I was just trying to state that it is good that they are talking about it. Remember about two weeks ago, not one word about it. I agree get this bloody thing done!!!!:D

ERBIL, Iraq: Kurdish and Sunni Arab officials have expressed deep reservations about the draft version of a national oil law and related legislation, misgivings that could derail one of the benchmarks for progress in Iraq laid down by President George W. Bush.


The draft law, which establishes a framework for the fair distribution of oil revenues, was approved by the Iraqi cabinet in late February after months of protracted negotiations. The White House was hoping for quick passage to lay the groundwork for a political settlement among Iraq's ethnic and sectarian factions. But the new Kurdish concerns have created doubts about the bill even before Parliament takes it up for debate.

And the issue comes at a sensitive moment for Bush, who is about to enter negotiations with congressional Democrats over the $124 billion war spending bill, which he vetoed Tuesday because it included timetables for troop withdrawals.

While Bush has emphatically rejected any timetables, he has supported the idea of benchmarks, as long as they are nonbinding. Any indications that the setting of benchmarks is a futile exercise could complicate those negotiations and add weight to the Democrats' critique of his Iraq policies.

The Kurds have taken issue with a new provision that was quietly packaged with the draft oil law by the Shiite-led Oil Ministry late last month. The measure would essentially cede control of the management of nearly all known oil fields and related contracts to a state-run oil company to be established after the law is enacted, a spokesman for the Kurdish regional government said Wednesday.

The spokesman, Khalid Salih, said that provision violated a clause in the Constitution that says the central government must work with regional governments to determine management of known fields that have not been developed. The Kurds, who have enjoyed effective autonomy in northern Iraq since 1991, have been arguing for maximum regional control over oil contracts.

The provision is part of four so-called annexes that will be debated with the draft oil law in Parliament. Any objection to one or more of the annexes would stall passage of the law.

"We are worried about these ideas put into the annexes," Salih said. "It worries us a lot."

If the law and the annexes go to a vote in Parliament, a rejection by the Kurdish bloc alone, which holds 58 of 275 seats, would not doom the law. But Parliament operates by consensus, and members say it is almost certain that no law regarding oil would be passed without the approval of the Kurds.

Adding a further layer of complication, a Sunni Arab legislator said Wednesday evening that the main Sunni Arab bloc, which has 44 legislative seats, objected to any discussion of the law in Parliament at this time.

"Acceleration in presenting it is inappropriate since the security condition is not encouraging," said the legislator, Saleem Abdullah. He said Sunni Arabs were also worried that the law would give foreign companies too large a role in Iraq's oil industry.

A senior Shiite legislator, Sheik Jalaladin al-Saghir, said the concerns raised by the Kurds amounted to a bargaining tactic. "I think it's a maneuver," he said, adding that he believed the Kurds "will move forward to pass the law, since everybody needs it."

White House officials and congressional leaders have said that passage of the oil law is one of four major benchmarks they want the Iraqi government to meet by the end of the summer. During a visit to Baghdad in April, Defense Secretary Robert Gates told the Iraqi prime minister, Nuri Kamal al-Maliki, that Bush would weigh Iraq's commitment to meeting the benchmarks when he decided late this summer whether to extend the recent increase in U.S. troops.

The draft law provides for the distribution of revenues from all current and future oil fields to regions or provinces based on population. That agreement was meant to assuage the fears of the Sunni Arabs, who suspect the Shiites and Kurds of conspiring to hoard the wealth from Iraq's oil.

A rocket attack on Iraq's heavily fortified Green Zone killed four foreign contractors working for the U.S. government, the U.S. Embassy said Thursday. It was the third straight day that extremists used rockets or mortars to hit the area where the Iraqi Parliament meets, The Associated Press reported from Baghdad.

The embassy initially said all those killed in the attack on Wednesday were from the Philippines, but later said one was from the Philippines, another was from Nepal and two were from India.

I don't get a summer vacation!!!...I work 60 hours/wk...and sometimes a little more...I need a vacation more than the IP does....and I don't have people trying to blow up my car, house, street, market or....me...Usually people get vacations AFTER they've done work...
