Hello, I have been in Iraq since May 04 and qualified for the foreign earned income exclusion in May 05 (out of the US for 330 of 365 calendar days). Since my 2004 Tax Return had been submitted earlier in the year (Feb, 2005), I filed an amended tax return for 2004 late last fall claiming the foreign earned income exclusion. The IRS rejected my foreign earned income claim because Iraq was on the restricted list of countries for a portion of 2004. But, the US and my company (DOD Contractor) have been in Iraq since 2003. Shouldn't one's total time in Iraq during 2004 be a legitimate claim? Has anyone else confronted this issue? Thanks. Wedgehawg.
